1. Introduction & Operator Details

These Terms of Usage ("Terms") constitute a legally binding agreement between you (the "Subscriber", "Member", or "User") and Sabrina Ashworth trading as Grails Collectors ("Grails Collectors", "we", "us", or "our"), an individual proprietorship established in England and Wales, United Kingdom.

By accessing our website, creating an account, subscribing to any paid VIP membership, or connecting to our private community channels and automated alert feeds, you explicitly agree to be bound by these Terms and our Privacy Policy. If you do not agree to all terms and conditions set forth herein, you must immediately refrain from using the website and cancel any active subscription.

2. Service Description & Alerts

Grails Collectors operates an online collector intelligence network. Our service includes:

• Automated real-time inventory and restock notifications for collectible products.
• Release schedule tracking, product leak discussions, and restock guidance.
• Access to private member community channels and discussion forums.
• Dedicated member role assignment across supported community channels.

We continually enhance, update, or modify our alert systems, monitored products, and supported retailers at our sole discretion to maintain service quality and reliability.

3. Third-Party Retailer & Brand Disclaimer

All product names, brand names, retail marks, trademarks, registered trademarks, and associated logos referenced on our website or within our notification feeds remain the exclusive property of their respective trademark holders. Reference to any third-party brand or retailer is solely for the purpose of identifying the goods detected as being stocked by those third-party sellers.

4. No Guarantee of Purchase or Availability

Our automated monitors scan publicly accessible retailer websites and send real-time informational notifications when inventory changes or restocks are detected. You explicitly acknowledge and agree that:

• Grails Collectors does not sell physical products: We do not manufacture, warehouse, stock, sell, or ship any collectible merchandise.
• Third-party retailer control: Product pricing, availability, purchase quantity limits, checkout queues, anti-bot mechanisms, and order fulfillment are 100% determined and operated by the third-party retailers.
• No guarantee of purchase success: High-demand collectibles frequently sell out within seconds or minutes. Receiving an alert does not guarantee that you will successfully complete a purchase or that a retailer will fulfill your order.
• Retailer order cancellations: Third-party retailers may cancel orders at their discretion. Grails Collectors bears no liability for retailer cancellations, delivery delays, defective items, or payment processing failures on retailer sites.

5. Subscriptions, Billing & Auto-Renewal

VIP Membership is offered on a recurring subscription basis across multiple billing tiers (including monthly, quarterly, and annual billing terms).

• Payment Processing: All subscription payments are processed securely through our authorized payment processor (Stripe). We do not store or process your full debit or credit card credentials on our servers.
• Continuous Auto-Renewal: Your subscription will automatically renew at the conclusion of each billing period (monthly, quarterly, or annually) unless canceled prior to the renewal date. Your saved payment method will be charged the then-current standard rate for your selected plan.
• Price Adjustments: If we adjust subscription pricing, we will provide at least 30 days advance notice via email or within the private community. Your continued use following notice constitutes acceptance of the modified fee.

6. Cancellation & Statutory Rights Waiver

You have complete control over your subscription and may cancel at any time.

• How to Cancel: You can cancel your subscription instantly with one click through the Member Access Portal or the self-service Stripe Customer Portal.
• Effect of Cancellation: When you cancel, auto-renewal is immediately disabled. You retain full access to all VIP channels, monitors, and alerts until the end of your prepaid billing period, at which point access is automatically revoked.

7. Single-User License & Anti-Scraping Policy

Your membership grants you a limited, non-exclusive, non-transferable, revocable license for your personal, non-commercial collector use only.

The following activities are strictly prohibited and will result in immediate termination of your account, expulsion from all community channels, and permanent blacklisting without refund:

• Re-streaming, scraping, forwarding, syndicating, or broadcasting our alert feeds, webhook notifications, or restock data to external channels, Discord servers, Telegram groups, or commercial services.
• Sharing, publishing, selling, or distributing private channel invite links or access tokens.
• Employing automated bots or extraction tools to harvest data or scrape our member portal.
• Reselling, leasing, or sharing account access with third parties.

8. Community Guidelines & Conduct

Our private community channels are intended to be friendly, supportive spaces for genuine collectors. Members are expected to conduct themselves with courtesy and integrity:

• Zero tolerance for harassment, hate speech, defamation, threats, or abusive language.
• No spamming, unapproved promotional advertising, affiliate link drops, or scam attempts.
• No malicious conduct aimed at disrupting community members or administrators.

We reserve the right to temporarily mute, suspend, or permanently ban any member who violates these standards.

9. Limitation of Liability & Statutory Consumer Rights

To the maximum extent permitted by applicable law in England and Wales:

• "As-Is" Provision: The website, monitors, alerts, and community channels are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied.
• Service Downtime & Delay: We do not warrant that alerts will be instantaneous, error-free, uninterrupted, or that external network latency, retailer blocking, or third-party platform outages will not impact delivery.
• Aggregate Monetary Cap: In no event shall the total aggregate liability of Sabrina Ashworth, Grails Collectors, or our operators for all claims arising from or relating to your use of the service exceed the total amount paid by you to Grails Collectors in the thirty (30) days preceding the event giving rise to liability.
• Preservation of Statutory Rights: Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any statutory rights that cannot be lawfully excluded under the UK Consumer Rights Act 2015.

10. Governing Law & Contact Information

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
